ok lets analyze this:

1. Two kids get drunk
2. the girl invites the guy back to HER DORM.
3. the two start making out, in HER DORM.
4. she says, "I don't want to have sex" [or at least she thinks she does, after all, she REALIZED she was having sex]
5. clothes start coming off.
6. more making out, touching
7. clothes are off [maybe not, but the two sex organs are definately readily available.
8. not another peep about not having sex
9. sex occurs.
10. she does nothing to stop the sex while it is happening, nor does she even say stop [according to what she has told us so far]

HOW does that constitute rape.
this is what the kid was thinking

If you made an honest attempt to deny this guy, and he kept going despite your denial, and you didn't lead him on (like I think it sounds), then ya, its rape.

edit: seeing that sober part, makes this all a whole lot more confusing. However, by the original post it makes it sound like you were both drunk, made out (led him on), then said "I don't want to have sex", then took off your clothes (led him on some more), and then it happened, then you said no. This guy sounds like a creeper to me though, no denying.

guys are not mind readers, if a guy is used to having sex with girls he is hooking up with and then you say "i dont want to have sex" he probably just thinks you are being stubborn, especially if you keep hooking up with him. if you really don't want sex say "STOP, i REALLY do NOT want to have sex." if you said THAT, then i would say its borderline, but the fact is, unless you are passed out or close to it, how is he supposed to judge whether or not you simply "didn't notice" you were having sex?

2. you can hook up with whoever you want. BUT DO IT RESPONSIBLY. if you are shit-canned wasted, DON'T INVITE A GUY BACK TO YOUR ROOM and start making out with him. DUH.

No, they're not. However, you need to realize what you did wrong here too. Only you can judge the events that happened, and if this was rape or not, but I read a lot of leading on. You shouldn't be taking guys back to your dorm and making out with them when your wasted, especially if there sober. There are guys out there that go to clubs, parties, whatever, and prey on drunk girls like you. Don't get yourself into a situation like that.

These guys are used to hooking up with drunk girls who never say no. they are not trying to rape you, they just think that you are out to have a good time.
You go out, get drunk and he walks you home, gets some, and all is happy, thats how some guys see it.
