As an Australian citizen, I am outraged that one of my fellow Australians is being held in a foreign military jail without charge.  David Hicks was taken into American custody in 2001 and has spent over four years as a prisoner in Guantanamo Bay.  He is being held here without charge.  This is a denial of his fundamental human rights.  I am not saying Hicks didn't train with the Taliban or Al Quaeda, however it is inhuman for the American government to deny his civil liberty for so long.  Article six of the UN declaration of universal human rights states: Everyone has the right to recognition everywhere as a person before the law.
This human right is being violated as well as articles 9 & 10: No one shall be subjected to arbitrary arrest, detention or exile. and Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.  
This is an agreement entered into by the United States of America, how can they then deny this man his rights as a human being.

I do not however put all the blame on the American government I believe that the Australian government has done little work to bring him home.  Our PM talks of America being a great friend to Australia however they seem to call no favors of them, or America just won't face facts that they should let him go.

BRING HICKS HOME!

Like you have said, about Australia being good friends with America, it will be all about politics. Sometimes I hate to say it, but politics can get in the way of human rights.
Anyway, most prisoners in Guatemala bay haven’t been charged (why do you think they put them away from prying eyes?).
Sometimes someone cant be changed because the evidence which they have, if from illegal sources but it is safer for the public for them to be locked away. In theory everyone deserves:  Everyone has the right to recognition everywhere as a person before the law. Etc but the world doesn’t work like that, not in practice.

I think it is quite ironic.  American was founded on the principles of freedom, yet they refuse to grant people one of the most basic of rights, a fair trial.  We dont know if anyone held in Guantanamo Bay are actually guilty of anything.  AS long as this prison still exists it is a stain on everything the USA represents.  How can they take the moral high ground on issues in the Middle East when they themselves are guilty of such cruelty?

America makes it seem like they are taking the moral high ground but they never do, invading Iraq, helped Sudan, Sudan had oil what a coincidence!  I just think that its hypocritical for America to use the UN for their own good but don't stick to agreements thay have made with UN!

Of course he should be charged or released. Guantanamo Bay is an embarrassment in which U.S. citizens have to endure.

WHAT!?!?! They can HANG PEOPLE in austraila?!?!? Isn't that considered cruel and unusual punishment? Does Austrailia forbid that? In the US, you cant do that... but really? youc an do that in Aussie? Whats up with that?

It doesn't literally mean that he would hanged its euphamism for being put to death.  And australia has no capital punishment unlike america

We are in the middle of a war if you have not noticed. Our soldiers die daily in the fight against terrorism. This man was training with Al Quaeda. Simply being in that company makes him a potential threat to the safety of the United States. Furthermore and this is just my personnal opinion, why should we fight and live by a code no one else follows. We should do what it takes to get the information we need to effectively fight a war. We should also be able to get this information at all costs. It may not seem right but there is simply no other way to fight a war.

I think to say that no one else follows the code is just such immature argument, the main reason no one else follows is the code is because they are too scared of the USA.  If other countries in the alliance with the USA don't do what the USA wants then they are in the deep end it seems to me that the world is run by fear.  'An eye for an eye makes the whole world blind' Ghandi.

We, and Americans in particular, fight for their nation and freedom. Its completely hypocritical to do so by denying someone else's freedom in an inhumane way. Us following the 'code' is what seperates us, what makes us the 'goodies' (even though that is debatable). If we sink to that level, then what are we fighting for? Freedom and human rights for all people? We can't hope to our own values of equality if we don't follow them ourselves. By refusing to act - whether it be to charge or release Hicks, both the Australian gov and the US gov are lowering themselves to the level of those which they are trying to stop.
