Alright. So if a woman steals a man's DNA and impregnates herself with it, should/would she be able to sue for child support? What should/would she be charged with? Does this count as rape? Should it? Any other moral qualms you can think of? Share them.

and i wouldn't call it rape. she didn't force him to have sex with her, she stole his sperm.

also, he'd have a realllllllly hard time proving this, yes? =P (that she stole it, not that it was rape.)

Rape is probably not.  It would be theft.  She certainly has no grounds to claim child support.  The child ought to be taken out of her custody in my opinion.  If he wants it he can have it, but if not then it should be put into the system.  She should reap no rewards for her crime.

Well it'd be easy enough to prove it was his once it was  born, a simple paternity test ought to do it.

My brother and I were having this debate. If she stole his DNA from him, and not from a lab where it was being kept, is it really theft? I'm not sure if anyone actually owns body fluids.

If a fetus is legally the property of a woman, I want legal ownership of my sperm.  How exactly is she taking it from him?

No, no. Prove that she stole it. Yeah, it'd be easy to steal it from a lab or whatever, but how would she know it was his?

Also, i have heard that women, after the man has thrown the condom in the trash, got it back out and took the sperm and got pregnant. it'd be real hard to prove that she 'stole' it.

I don't know how she would go about stealing it.

The way she got it in Voyager isn't really possible in today's world. What are some situations you can imagine someone being able to steal sperm?

Drug the man and then use a syringe to extract it.  If that's medically possible.

Or from a sperm bank, only he gave it to be used there and I don't think sperm donors are child support liable.

What if it was in a lab that did in vitro fertilization? That way it's not really sperm donor, but the guy certainly didn't consent to fertilizing someone other than his chosen partner.

I'm just doing these situations to see what you people think about minor differences in essentially the same crime.

I love hypothetical ethicals.  No need to explain.

Regardless of how she does it, if she takes his sperm without his consent, she has committed theft at the least.  And as you are not legally allowed to benefit from a crime the child must be first offered to the biological father and then turned over to be a ward of the state.
