As a former competitive swimmer (12 years), I can honestly say that I have seen touchpads fail hundreds of times.  They are just like any other electronic device.

If you don't hit them hard enough, or in the right spot, they dont stop.

Of course the ones they use at the Olympics are very accurate, but it is not impossible that the time was faulty.
