well i mean if the topic is about a video and people are too stupid to click on the link and instead sit back saying 'hur hur hur fail' its pretty non contributory

Absolutely not.  

"Fail" posts can contribute plenty.  As with all things, there are certain situations that would call for a deletion for such a thing (support topics), but in most cases coming to mind right now, they are contributive.

Show me some examples.

It's not spam.  I only post it when it's true, or if I'm in an asshole mood.  It's legitimate commentary when used correctly.

Though, not in response to my posts!  Those fail posts should be deleted!

Meh.  I don't think it's necessarily a violation of the terms of use though, in all seriousness.  Though, in response to serious help threads, it is inappropriate and should be deleted as such.
