Being pulled over while having prescription drugs in your car.

Yesterday me, my girlfriend, and three of our mutual friends were driving in my car on the way to buy some weed while we were all taking Xanax.  We got pulled over (I guess my car was drifting?) before we got to our destination and the officer saw that we had pills in the car.  When asked what they were I told him that they were Xanax.  It looked like we were going to get screwed since everyone else in the car turned white, but fortunately I was keeping my prescription bottle on me (since it contained over 100 pills) at the time and was able to prove that they were not obtained illicitly and we were let off the hook.

But what happens if you are stopped with pills in your car and *do not* have the bottle or the prescription on them at the time.  I'm sure not everyone carries their bottle around with them.  I saw an episode of COPS once in which a girl was stopped for speeding and the officer found Soma pills in her car.  They were in a bag, and she didn't have any proof that she didn't obtain them illegally (even though she looked like a crackhead and probably did), so she was arrested.

Does this always happen, even to people who are using the drug as prescribed yet do not happen to have their prescription on hand?  Has this ever happened to you guys?

I would imagine that if you could prove that they weren't obtained illegally you wouldn't have to pay the fine.

the police officer would probably take the drugs away for testing to see what they where, and probably make the individual in question take a illegal drugs test
if it wasn't anything major like e, heroine, etc
they would usually let it go
you gotta remember loads of people have prescription drugs in their car
so i doubt the police car would really bother

You get arrested and charged and then you use your phone call to ring someone to bring proof down and then the charges are dropped.

That's how it works.

EDIT: That's what happens for prescription drugs only.
If it's over the counter crap it doesn't matter.
But for anything with a prescription they usually arrest you.

Could you not ask the officer to go back to your house with them and prove the perscribtion...
im sure the police here would let you.

If you don't have evidence that they weren't obtained illegally they will charge you, but if you can provide the evidence late, ie going home and getting it - you won't be.

I suppose it should be asked why the pills were in a position that a cop could see them to begin with.

As for not having the bottle on you and getting busted? Nothing. You go to court and contest it...and win....if it even gets that far.

This all seems like a whole lot of trouble for regular, decent people who did not obtain the drug illegally to go through.  So now even non-drug-abusers are falling victim to the War on Drugs?  This is the saddest thing ever.

Eh, everyone was taking them, people were holding them, I guess everyone was too scared to think of hiding them.  They're all drug addicts too.

It's sad but only because there are people who have made the situation bad enough that it's warranted. I know it sounds dumb but you can't always look at a person and say, "He's a drug user. He's not. She is. He's not." and people do abuse these drugs. There are drugs you can't even purchase over the counter anymore without an ID and Xanax is one of the most abused of its kind and, unless I misunderstood your OP, you were abusing them yourself and I highly doubt that if I were to see you in person, I'd say to myself, "Oh yeah, that guy right that abuses Xanax for sure.".

Well, the fact that they abuse drugs in the first place makes them appear, *ahem*...a little...slow?...put kindly... And I must say, it's kind of funny that he would say that it's sad that this is what things have come to because he's one of the people who have brought it to this so he, as just another addict or at least someone who associates with them (in which case, they're among the people who have brought the situation to this), has little reason to complain.

If you are holding prescription drugs without a prescription, that's definitely enough to confiscate the material, and even potentially bring you down to the station for questioning. If you can provide proof that the drugs are yours and that nobody else took them, then you should be fine.
