It actually is legal in the US. The main psycoactive ingredient (thujone) has to be under a certain level to be sold in the US. It contains half to a third the amount of "real" stuff, but is still real.

It has a hallucinogen drug in it, which is believed that, compared with regular alcohol, can cause convulsive seizures if ingested in large amounts... However, the less the amount of thujone, the less amount of negative side effects. This is why the United States is so anal about the amount of thujone in their absinthe. People think it is the real shit since it has been legalized in 2007. But it can only contain less than 10ppm thujone... which then this absinthe is considered to be thujone-free! So therefore, no it is not the same thing to all you other people out there.
