There are data recovery programs which are specific to SIM cards for restoring messages which have been deleted. The main problem is that phone is CDMA and does not have a SIM card. I'd say a subpoena from the police could force the company to pull a backup from a server but that's probably only going to be available for a somewhat limited period of time, possibly days.
