Yes a mod could say this.

Generally the word used is "discretion" which they have a good amount of.

That said if you are mistreated or arbitrarily moderated against and you report it then it will always get discussed and any mod who said "i was deleting his posts because i have the power to delete his posts" would quickly find your posts returned and his ability to moderate removed.
