Jan. 7) - When they were married, a New York doctor gave up one of his kidneys to save his ailing wife. Now they're getting a divorce, and he wants it back. Dr. Richard Batista said Wednesday he is suing his estranged wife, Dawnell. Since he doesn't really expect her to return the kidney, he is demanding $1.5 million in compensation instead.

Batista claims his wife had an affair. "There's no deeper pain or betrayal from somebody you loved and devoted your whole life to," he told a news conference at his lawyer's office in Garden City on Long Island. Batista, 49, who works for Nassau University Medical Center, said he gave his kidney to Dawnell Batista in June 2001. She filed for divorce in July 2005.

The Batistas have three children, ages, 8, 11 and 14. A message left for Dawnell Batista's attorney, Douglas Rothkopf, was not immediately returned.

The bitch deserves to get sued, i would hate it if i saved some bitchs life only to be cheated on.

Now you could use the argument, but just becuase he did it doesn;t mean she has to love him, thats tru but if she didn't like him they could just get a divorce instead of cheating.

Right, marriage vows are a fucking joke, 50% of people don't take them seriously. Does this mean that you should kill or seriously impair the person who didn't take it seriously?

Instead he asks for 1.5 million for what is considered a donation of organs?
Man I wish I could give someone my organs, say they weren't using them how I wanted them too, and then sue them so that I was easily set.

You can't sell your organs legally, so I don't see how this would go through, since he is literally saying that the lack of a continuous relationship means he is suddenly charging for (literally) the gift of life. No matter how fucked up cheating is, playing god like that is more fucked up.

I wouldn't consider it part of the marital assets and it shouldn't even be a part of the divorce settlement. As you said he's a fucking doctor, the estate is going to be hard enough to divide as it is.

its not being vindictive...his vowels when the y got married said..until death do us apart....and obviously she was like fuck that...I want some other shit.....so 1.5 million aint shit.....take into consideration the cost of surgery, days out of work he is a fucken doctor and they make alot of mullah and other costs associated with removing the kidney...he probably payed for her surgery to..dammm hes a good guy

Uh, I'd rather get cheated on and preserve life, than kill someone because of 'betrayal' and all that crap.

But that's just me.

It's her kidney now, he donated it to her, it's definitely not part of any marital agreement, since these kind of transplants happen all the time outside of marriage. He needs to get over it and move on instead of being a vindictive cunt.
