But In India for Driving after Drinking is a Crime because it may cause accidents . Actually, my friend, you can be dead sober and still get a DUI, its happened here in Texas a lot of times. By Texas law, and many others im sure, Driving Under the Influence is defined as being affected by or hindered by alcohol while driving. Therefore in Texas even if your the DD and your friend is in the backseat drunk, if he smells the alcohol he can write you a DUI even if your sober.....its a raw deal and stupid really, but its happened to a close friend of mine and a judge upheld it in court when he fought it. If the cops' a big enough dickhead he can write you a ticket..... i r sekz Posted at 9:09 am on Mar. 10, 2008 Depends on the state.  In Maryland, if you are over 18 you can have alcohol sealed in your trunk.  Remember if you have a 6 pack and 1 beer is missing it is considered open. b smith07 Posted at 4:04 am on Mar. 10, 2008 in texas the law states that if your a minor you can carry unopened containers of alcohol in a stowed away place not readily accessible by the driver. In other words behind the backseat of a four door vehicle or in a toolbox. however if the cop has a reasonable intent to suspect alcohol, he can search any unlocked areas of the car. So your best bet is to carry it in your toolbox, with the hatch locked. The best bet would be to keep it in the trunk, and unless law enforcement has probable cause, don't let them search your vehicle (this is good advice regardless of the situation).
