Dodging an animal can cause a lot more than a scratch. Not all animals have micro chips, and around here, vets are simply going ti say "and"? If a dead animal is reported. The cat could have run out before they had a chance to react, the cat could have run out directly in front of them, straight under the tire or under the back tire. I'm not trying to argue. Dodging an animal is not only sometimes impossible, but also unadvised and dangerous. Dodging an animal can cause an accident, and as horrible as PETA believes it is, human life is more important than a cats. If it was dark, it's likely they didn't even see it. I don't see the point in speculating to place blame. Why would you call a vet to tell them you killed a cat that was in the road?
