I got in the biggest trouble today. The consequences are:
- I got kicked out of my house
- I'm now living with my friend
- My step dad said "I'll see you in jail"

What I did:
- I had sex with my step dad's sister.
- I'm 18 shes 15

How I got caught:
- My little brother told my sister to get out of the bathroom
- My sister went out and he found me
- My dad immediately called the cops

The cops came in the house :
- I lied to the cops and told them a story.
- The cops interrogated both me and my step sister.
- According to the cops, it seems like they know all the information about my step sister and I.

Things on my side that I suspect:
- Though the cops asked for where the condom is, I didn't tell them where it was and they were threating that they will test my sister in the hospital. I think this could be in my side because why would they be looking for proof if they already believe my step sister?

I will add things as I go through, but for now thats what I have. I mean sure my life could be messed up, but hwo mess up can it be now? My life right now is so low that I really don't care that this thing is happening. I mean at least now I feel that something is coming up, I feed on drama. I like whats happening to me now, specially when I'm going to jail. At the same time I know its going to be bad whats up for next and such. What is your feedback guys?

So anyway, I'm in the state of Iowa and stuff so let me know the laws and stuff. I know at worst I could be facing 15 years in prison and such and be marked as a pedophile. I haven't smoked weed or gotten drunk in my entire life. I've never been to jail and such. I know I messed up but damn I feel like they are treating me like I killed someone.

Fact: if you didnt say anything and she didnt say anything, they have nothing!!!

Fact: they cannot FORCE her to have a vaginal examination.

Fact: if the find that condom your FUCKED

Thought: 18 and 15, only 3 year age gap, if both of you say you wanted it, and were happy, you'll get a slap on the wrist.

As long as both of you don't say anything at all, and get some kind of lawyer to represent you, they don't have any proof other than some circumstantial guesswork. They can assume you were having sex, but there's no evidence to support it without the condom.

If they do find the condom, you're in a really bad position. Don't lie, but don't say anything at all. When the police question you it's not illegal to tell them something false but it doesn't help your case at court.

They can't force your sister to a vaginal exam without her consent, because this wasn't rape and they probably know that. Even then unless they find a pubic hair or semen sample all they can prove is that she's had sex, not necessarily with you.

It is an unlucky situation, but don't make it worse by lying to the police. Get your facts straight and don't say a word without a lawyer or a public defender.

Okay so I did say a bunch of things and so did my step sister. My sister is actually told them the full story and such. So what happens now? Its least likely that they will find the condom because even I don't know where it is. I did say that the condom never existed. As of now the problems I'm facing is that my step dad believes my sister's story and such and kicked me out of the house. What kind of charges my dad can press against me? What can happen in this situation and what other things should I know?

What did you sister say? Did she lie or did she say that you had sex? In that case don't tell the police anything, if you do you shouldn't lie because it will make it worse for you if you're lying and she's not. What would she have said that she kicked you out but not her? I thought you two both wanted to do it?

We really can't say what will happen because we're not lawyers or judges. At this point all I can say is get some legal representation and consult with them for your best options and what will happen.

Well the cops didn't say anything but I assume that she admitted everything because my step dad was really really pissed off and the cops were asking me for the condom. I technically didn't lie because the cops asked the question the wrong way. Well yeah we both wanted it.

But yeah thanks anyway.I just need maybe support and such.

As for the law, you're in Iowa and that would put you in a more favourable position. The age of consent is technically 16, but "sexual acts involving a 14 or 15 are permissible so long as the older person is not more than four years older than the younger, the older is not related to or living with the younger, and the older is not in authority."

The problem is that whilst you're not related to her, you are living with her and this changes things considerably. This means the age of consent is 16, and because no matter what she says she cannot legally consent to sex, so the district attorney would be able to prosecute for statutory rape as you're 18 and she's under the age of consent.

Iowa code §709.4 states:


A person commits sexual abuse in the third degree when the person
     performs a sex act under any of the following circumstances:
        c.  The other person is fourteen or fifteen years of age and
     any of the following are true:
        (1)  The person is a member of the same household as the other
     person.

        (2)  The person is related to the other person by blood or
     affinity to the fourth degree

So sadly you're not just simply out of the wind, but don't give up hope and like I said get a lawyer.
