However, it happens. Especially if the bar is busy. We do that all the time. Go to a busy resturaunt, order non alcoholic drinks, just knowing they will not realize and add the appropriate alcohol. No one is really at fault. If you are not with your parent or legal guardian, its illegal. Its illegal for someone else's parent to give someone else alcohol. IF you ARE with your parent, its legal.
