Can someone fire you because you didn't tell them you were pregnant in an interview. Though no one asked and the application said not to imply it?

-- Posted by GEEraffBby at 9:39 am on Jan. 5, 2009

No.
It's called discrimination.

-- Posted by abbigayle303 at 9:39 am on Jan. 5, 2009

i guess

-- Posted by RachelLouise at 9:39 am on Jan. 5, 2009

Certainly not in my Country. Dunno about yours though.

-- Posted by ladybughope at 9:40 am on Jan. 5, 2009

i think so because they don't want to go through the process of training you just to have you leave in a few months... they did that to my sister and thats the reason they gave

-- Posted by cum funnel at 9:40 am on Jan. 5, 2009

depends on where you live and what the business is

here, you can be fired for any reason other than the obvious
pregnancy will take away time from your work, it's going to hinder it in some way eventually
so they can reserve the right if your state doesn't shun it

-- Posted by dunebug at 9:40 am on Jan. 5, 2009

So far as I know it's illegal to be fired purely for pregnancy, that's discrimination. However, it doesn't stop most companies as they'll fire you for some other lame reason, when in fact it is because you're pregnant.

-- Posted by isobel at 9:40 am on Jan. 5, 2009

If it's going to affect your job, you should mention it. Whether they can fire you or not, I don't know. Even if you don't get fired, they sure won't like it.

-- Posted by 2kewl4u2know at 9:41 am on Jan. 5, 2009

I don't think so.  It wasn't required on the application nor necessary for them to know.  Also, if they asked you and didn't let you have the job then you could file for discrimination.  But I don't believe you could get fired for not telling them you were pregnant at the interview.

-- Posted by audrey820 at 9:41 am on Jan. 5, 2009

No, they aren't allowed to discriminate based on that. They have to accommodate you once you're employed. And give you maternity leave. Then as long as you come back within the proper time period, give you your position again.

Depends on the state in the US.  In Maryland they do not have to provide a reason for termination.

-- Posted by starfishface at 9:41 am on Jan. 5, 2009

Surely they noticed in the interview. Didn't you say you were 6 months gone?

No and I don't think they noticed. They might not notice when I go in tomorrow either.

this, at my work, if they want you gone, they can find one little thing, and get away with firing you.

We have a union they would have to find some legitimate reason I believe.

-- Posted by katrinadoodle at 11:15 am on Jan. 5, 2009

No. It's illegal... unless your pregnancy would directly interfere with you doing your job (for example, if your job required you to fit into tight spaces that a pregnant belly could not fit into.)

It's not a state thing, that's a national thing. Any form of disrimination is illegal.

However, your company may have a probationary period, where during a set time(At my work it's 3 months) they can fire you without giving you a reason, but after that they must have a valid reason. Although you may not be getting any money during your mat. leave because you will not have been working there very long.

I think you can be fired for with holding pertainent information, and being pregnant is something that they have a right to know about.  They may have regulations and such.  Especially if it is incorportated with some kind of insurance.  I know where I work if you don't tell them you are pregnant when you get hired, or within 3 months of being pregnant, you can lose your job.

-- Posted by MissPrixy07 at 9:36 am on Jan. 7, 2009

I'm not really sure. I think, though, that it's illegal to fire you because of that. If they didn't ask you, or notice in the interview, I think you should be fine. I would have an attorney on hold just in case, especially with a baby on the way. I wasn't working while I was pregnant with my little girl, so I'm not really sure how that all works out.

That policy is illegal. The Pregnancy Discrimination Act prevents an employer from refusing to hire or firing a pregnant woman due to her pregnancy or a pregnancy related illness.

If it was, they wouldn't be doing it.  They would be unable to do the job, and they are required to tell within 3 months because they don't want to be responsible for harm to the fetus.  If you tell them, they move you to a different department, where you can do the job.  If you don't tell them, you can be fired.

-- Posted by Chava at 12:02 pm on Jan. 7, 2009

If you didn't tell them then they wouldn't be liable. Besides I wouldn't have to disclose any other medical information unless of course I was driving and had seizures or something like that but pregnancy doesn't interfere with work at all usually until around 8 months or so. Even then it's about a month off and then you're back to working so I don't think it's pertinent for them to know until around 7 months unless something you're doing could harm the baby and then there would be no reason not to tell them. But my job requires me to push buttons.

That's still wrong. You're not legally required to tell your employer about any personal information about yourself or your family. You don't have to tell them if you're pregnant and they can't fire someone for not disclosing the information. They also aren't liable for any harm that comes to the fetus as long as they inform ALL employees of any danger that could come to the fetus in the event of a pregnancy.

So I wouldn't even have to tell them why I need to miss a month of work and can bring in a doctor's slip writting it off as surgery or a medical emergency. (Surgery in case of a C-section)?
