What are the general laws of transporting alcohol in a car?

its in the Trunk,

Does it have to be sealed, what if its been opened?

Both for Minors and Legal persons.

Thanx.

You're not supposed to have it in your car if you're a minor.

You're not supposed to have it open in your car at any age.

-- Posted by purplefrenchfry at 7:45 pm on Jan. 7, 2007

Sealed.
If it's open, they'll charge you with it.

If it's sealed and in the trunk, they can't do anything because it's out of reach and shows no signs of being open.

It cannot be in arms reach of the driver. It has to be sealed. If it is not, it has to be in the trunk. If you are the driver and are under age, you can't have it at all.

If it is open and you are under 21, against the law.... but I think if it is in the trunk, no matter what it should be legal, it isnt anywhere where you can get to it while driving...

I think it might depend on where you live.  Here, it's not permitted to be anywhere in the car if you are a minor.

Obviously, an opened container of alcohol in the car (doesn't matter who has been drinking) is a no no. The best bet would be to keep it in the trunk, and unless law enforcement has probable cause, don't let them search your vehicle (this is good advice regardless of the situation).

you can get charged with minor possession. if its open than they can charge you for DUI and open container + minor possession.

DUI for what? If you aren't under the influence, you can't be charged for DUI. Moron.

One has to be under the influence to be charged with a DUI.  And it is a fine, court-date, and/or license revocation/suspension for transporting.

Not 100% sure but pretty close to it that atleast in CT you can have closed alcohol in your car if you are a minor as long as someone of legal age is present in the car. This law probably changes from state to state though.

Ummm.. don't any of you know that it's legal to transport alcohol for someone over the age of 21 even if you are under the age of 21?

If you are driving the car and have the open container next to you they can charge you..believe me I was in the car when it happened, thank you very much.

in texas the law states that if your a minor you can carry unopened containers of alcohol in a stowed away place not readily accessible by the driver. In other words behind the backseat of a four door vehicle or in a toolbox. however if the cop has a reasonable intent to suspect alcohol, he can search any unlocked areas of the car. So your best bet is to carry it in your toolbox, with the hatch locked. Also any open container in the cab is illegal at any age. open containers in the bed do not count however

Depends on the state.  In Maryland, if you are over 18 you can have alcohol sealed in your trunk.  Remember if you have a 6 pack and 1 beer is missing it is considered open.

Actually, my friend, you can be dead sober and still get a DUI, its happened here in Texas a lot of times. By Texas law, and many others im sure, Driving Under the Influence is defined as being affected by or hindered by alcohol while driving. Therefore in Texas even if your the DD and your friend is in the backseat drunk, if he smells the alcohol he can write you a DUI even if your sober.....its a raw deal and stupid really, but its happened to a close friend of mine and a judge upheld it in court when he fought it. If the cops' a big enough dickhead he can write you a ticket.....

Where are you from?
At least where I am it's fine to have alcohol in the car as long as it's not open or in reach of the driver(even if you're a minor).

i think in NZ we can only get done if we are underage and are drinking...well drinking and driving too. Usually the cops will make you tip out any open bottles.. but if you get a nice cop then the other unopened drinks remain safe :P

-- Posted by climber783 at 7:35 pm on April 17, 2008

In Illinois, its illegal for any alcohol transport underage, closed/sealed or not.

Once you are 21, it must be sealed, in back seat or trunk.  No open drinks for any passengers.

In India you are not allowed to have alcohol till the age of 21 when you are 21 you are allowed to have it.
But In India for Driving after Drinking is a Crime because it may cause accidents .
As i concern DRINK AND DRIVE is a big risk to life
